Prior information concerning distance selling

Section 6 a of the Consumer Protection Act (38/1978) provides for traders’ obligation to provide information to consumer customers in the context of insurance business carried on using remote means of communication.

Insurance business carried on using remote means of communication (distance selling) means the provision of insurance to consumers by way of distance offering whereby the conclusion of contracts and the marketing that precedes this are effected solely by one or several remote means of communication.

‘Distance offering’ means a method of marketing or selling so arranged that its primary purpose may be deemed to be the conclusion of contracts through a remote means of communication.

‘Remote means of communication’ means telephones, the postal service, televisions, information networks or other instruments which can be used to conclude a contract without the simultaneous physical presence of the parties.

This prior information concerning insurance business carried on using remote means of communication (distance selling) applies to the provision of insurance on the insurer’s website and in telephone communications.

Insurance is not subject to the provisions governing the right of withdrawal laid down in Section 6 a of the Consumer Protection Act. The Insurance Contracts Act contains provisions on policyholders’ right to withdraw from and cancel insurance contracts.

According to the Insurance Contracts Act, the policyholder has a right at all times to cancel insurance to end during an insurance period. Any cancellation must be made in writing. If the policyholder does not indicate when insurance is to end, insurance ends when the notification regarding cancellation is issued or submitted to the insurer. However, the right of cancellation does not arise where the agreed period for which an insurance contract is in force is shorter than 30 days. In the event of cancellation, the applicable premium will be charged from the beginning until the termination of insurance.
